I killed him by suffering a "gay panic." It was his fault, he was gay

NEWS.- The defense of the "Gay panic" has been used around the world by assassins to get acquitted of all their acts. Defense that has served and served on many occasions.

But what is this law?

This law dictates that any heterosexual person can suffer a real panic to discover that the person next to you belongs to the LGBTI community. This irrational panic can lead you to commit murder. But it's not his fault, not even a violent person, the blame is on the homosexual person. That with his "strange" tastes causes an unusual reaction in society. Therefore, any murder committed on another person belonging to the LGBTI community is not a murder, and should not be understood as such.

Human rights activists have protested for a long time against this legal remedy as "deeply homophobic" Last month a bill passed by the state assembly, in California, proposed its elimination. Being currently eliminated.

This law has not been so alien to Spain as many would believe or would like, already in the 2009 a man, Jacobo Piñeiro, was absuelto by a popular jury of double murder, after he claimed that he burned the house of a gay couple due to "unbearable fear". Luckily the Spanish justice forced to repeat the trial with a new jury. And Piñeiro was found guilty sentenced to a penalty of 58 years of jail, penalty that was confirmed by the Supreme Court.

The case that has transcended the world, was the murder of American student Matthew Shepard, killed in October of 1998 just outside Laramie, in the state of Wyoming, by two men he had met in a bar. Aaron McKinney and Russel Henderson, at that time of only 21 years of age, claimed that they suffered "A moment of madness", when Matthew supposedly advanced towards them with "Sexual intentions". But due to media pressure, both were charged with murder and are currently serving a double penalty of consecutive life imprisonment.

One example, of which there is still talk, was the defense of Lawrence Reed, accused in March of 2013 of murder of Marco McMillian, First openly gay candidate to the City of Clarksdale, Mississippi.

Since then, the criminal justice section of the American Bar Association (American Bar Association) proposed to its members a series of measures against the use of this strategy. The proposal was unanimously approved in August of 2013 by the assembly of that organization, to which they are affiliated more from 400.000 lawyers, including recommending legislative measures like the one now passed in California.

Good news for the LGBTI community. But likewise, a piece of news that reminds us of how much remains to be done, when there are still courts around the world that accept the defense of "Gay panic", as a true defense.

That this term is used in many countries is, of course, a insult to human intelligence, to goodness and to society. Although we must celebrate that in California this defense has finally been abolished, considering it as "A nonsense", it is worrying to know that in many places said approach is legitimate.

The world society still has to mature, mature enough to include laws such as the one approved yesterday in the Parlament de Catalunya (Spain). A law that eradicates homophobia, but not only that it punishes her for violating the right to human freedom, but also obliges her to include, in education and in society, to treat sexual diversity as a totally normal fact.

two-moms-and-two-moms

A law that we hope will be imitated by all the regions and countries of the world.

3 opinions about "I killed him by suffering a "gay panic." It was his fault, he was gay"

  1. In the case of Spain, in a first trial he was condemned by the fire, since when he set fire to two homosexuals he put the rest of the neighbors in danger, but not for murdering two gays with rage, because of the gay panic. And it's not a joke.

    1. Exactly. It is absolutely deplorable that in many countries it is still used as a defense. It is incomprehensible that there are societies that admit it. Thank you for your contribution Diego.

  2. Let's see before being homosexual or heterosexual we are people ..
And I think that if a poor citizen gets x years in jail and these people are afraid or panicked of a homosexual, they don't put him in jail and they can take the law into their own hands ...
In what the hell country do we live that there are no equal conditions ...
And being homosexual is not a disease or being involved in any sect ...
Find a solution and change those regulations ... That homosexuals live and let live ... But heterosexuals don't ... they always make us empty since they know we are gay, lesbian or transsexual ...
Let there be laws for everyone alike ..
    Thank you
