A law to eradicate homophobia

EDITORIAL.- The October 2 will go down in the history of LGTBI collective rights as the day when a giant step was taken. Tomorrow the Parlament de Catalunya, approves the "Law on the Rights of Gays, Lesbians, Bisexuals, Transsexuals and Intersexals and for the Eradication of Homophobia". Because from legal equality to effective equality there is a distance comparable to that between the paternalism of tolerance and real respect for difference.

The obstacles put up by the PP with its delaying maneuvers have been of no use. In the month of July, the approval of the text was suspended after the presentation before the Consell de Garanties Statutàries of some fundamental articles of the text by the PP. The aforementioned establishment gave the go-ahead for three weeks and the popular have no choice but to vote against.

The law will allow not only pursue and punish discrimination, but will also emphasize educate in the respect of orientation, identity and gender expression.

The sanctions, which may range from mild to very serious, will penalize degrading expressions, prevent access to certain establishments and harass someone or members of their family because of their sexual orientation or condition. An important aspect is the call "Investment of the burden of proof" which implies that it is the alleged discriminator who must justify that he did not do the damage and not who has suffered.

It is therefore a question of combating the bases that sustain homophobia in a transversal way in all areas, labor, cultural, educational and health.

We would emphasize in the educational field the intention of to include in the textbooks respect for difference and combat bullying  in educational centers. As for health, any type of reference to the LGTBI collective as pathology will be eradicated and guaranteed lesbian access to assisted reproduction under equal conditions.

The cases of transsexual people receive special attention, since article 22 indicates that in public administrations, especially in the educational and university fields, the conditions for them to be treated and named according to gender must be established by regulation. with which they identify, even if they are minors.

We can not but congratulate ourselves and congratulate the Catalan institutions for this impressive contribution to effective equality for the whole collective.
