NEWS.- An amendment to the bill to reform the Penal Code that would authorize judges to submit to the Congress has been presented to the Congress of Deputies. close web pages in which "preponderantly" homophobia and transphobia are encouraged among other causes of hatred. The initiative, which has been run by the Popular parliamentary group, contemplates causes not foreseen in the current law.
According to the PP proposal, penalties of up to four years 'imprisonment and twelve months' fine for those who "foment, promote or incite directly or indirectly to hatred, hostility, discrimination or violence against a group, a part of it or a person determined by reason of their belonging to it for racist, anti-Semitic or other ideological reasons, religion or beliefs, family situation, belonging to an ethnic group, race or nation, national origin, sex, orientation or sexual identity, for reasons of gender, illness or disability.
In this sense, the amendment establishes that "the Judge or Court shall agree on the destruction, erasure or disablement of books, archives, documents, articles and any kind of support that is the subject of the offense referred to in the preceding paragraphs or by means of which would have been committed. "
As established by the PP proposal in Congress, "When the crime was committed through information and communication technologies, the withdrawal of the contents will be agreed upon. In the cases in which, through an Internet access portal or information society service, the contents referred to in the previous section are exclusively or predominantly disseminated, the blocking of access or interruption of the provision of the same shall be ordered".
The same penalty of one to four years would affect "those who produce, develop, possess for the purpose of distribution, facilitate access, distribution, dissemination or sale of written or any other kind of material or media that are suitable for their content to third parties. to encourage, promote or incite directly or indirectly to hatred, hostility, discrimination or violence against a group, a part of it or against a person determined by reason of their belonging to that group ".
Considering that this proposal protects individuals and groups for reasons of sexual orientation and gender identity, we can not but congratulate ourselves. Let the Popular group present the amendment, it is a clear signal that we have entered an election year and that the struggle, given the situation we are living in and the emergence of alternative options, is going to be very close. Well, welcome the electioneering measures if they contribute to improving the living conditions of the LGTBI collective and the general public. We will not give our vote to anyone for the face, before they must prove that they deserve it because they take us into account.
