A man has been sentenced to a sentence of four months in jail and to pay one compensation of 7.000 € for having verbally and physically assaulted one of her acquaintances for the mere fact of being a lesbian. The accused has acknowledged the responsibility and has asked the victim for forgiveness, which has meant that the magistrate has pronounced the sentence "in voce" by a crime of injuries with the aggravating of hatred and discrimination by lesbophobia.

The events referred to in the judgment occurred in August of the 2015 in a street in the Sants-Montjuic district of the city of Barcelona, ​​where the victim and accused who already knew each other met and he began to recriminate the woman who had masculine attitudes and that its behavior was own of a man. The situation turned into insults and serious physical assault. Fortunately, a passer-by who was passing through the area helped the woman and notified an ambulance so that they could treat her of the injuries caused by the blows of her attacker.

The victim, after going to Observatory against Homophobia of Catalonia, he went to the Service of Attention to Victims of Crime of the Generalitat de Catalunya, where, in addition to providing the necessary psychological assistance, they accompanied her to file a complaint with the police, in this case the Mossos d'Esquadra, who did not take long to identify and locate the aggressor.

Following the agreement of the parties, the defendant has deposited the amount of 7.000 € corresponding to the compensation and has apologized to the victim with whom he has a restraining order of 2 years. In spite of the seriousness of the facts, he should not enter prison because he has no criminal record and is worth less than 2 years.

For his part, the president of the OCH, Eugeni Rodríguez, has told the agency Efe that this sentence “is very important because it is essential that hate crimes against lesbian women be punished severely because we are observing that there is an increase of aggressions against lesbians, either because they now have greater visibility or because they report cases more ». We applaud that we are finally beginning to hear sentences that make it clear that homophobic attacks do not come for free.
