NEWS.- 240 € is the amount that the fine imposed on a taxi driver by the Court of Instruction number 6 of Barcelona amounts to uttering insults considered homophobic and racist in a traffic discussion.
The insults were directed against a gay couple of Ecuadorians They rode with their bikes down the bike path where the taxi driver had parked his vehicle. He argued that one of the bicycles had hit the taxi causing flaws in a fin, despite the fact that in the trial he declared not having seen the facts but having heard the blow. In any case, he did acknowledge having called "Sudacas de mierda" and "fags" to the two cyclists. Fortune wanted that at that precise moment two agents of the urban guard of Barcelona would appear, one of whom has declared in the trial to have heard the insults uttered by the taxi driver.
Judge Miguel Ángel Tabarés, based on Article 620 of the Criminal Code, has condemned the taxi driver to a penalty of 240 € for considering proven insults and the express intention of doing harm. According to the sentence, "The offensive words addressed to them refer to the personal circumstances of the victims who in a society like ours have to be specially protected: sexual orientation and the status of foreigners". The judge also considered relevant that "those words were shouted, in public, with obvious intention to humiliate their recipients to other users of the road, which the injured say that the convicted got". The pair of cyclists was acquitted on the grounds that the relationship between the incident and the scratching of the vehicle could not be proven.
The Observatory against Homophobia through his spokesperson, the lawyer Laia Serra, has celebrated the ruling for considering that it takes seriously the situations of abuse that people of the LGTB collective suffer daily.
It is worth mentioning the fact that despite having Catalunya with a Law against the LGTB phobia, the sentence has been made, as we have already pointed out, based on the Criminal Code, current throughout Spain.
