The Trans Law saves its first process in Congress with deep differences between PSOE and Podemos
Yesterday was a key day for the advancement of the Trans Law. Most of the Congress flatly rejected the two amendments to the whole tabled by the Party y Vox, who asked to return the text to the Government. Thus, the starting signal has been given to the legislative process by way of urgency of a norm that is expected to be very agitated.
It is one of the star laws of Ministry of Equality directed by Irene Montero and one of the ones that has generated the most tensions between PSOE and Podemos. This Thursday he has saved his first parliamentary procedure in the Congress with the votes of a large majority, but the profound differences between the two government partners remain.
The most controversial point is gender self-determination of trans people, that is, the right to modify the legal sex based on their free will. Currently, there is already Spain since 2007 a law on gender identity and that allows the change in the DNI, the difference is that it imposes as requirements two years of hormone and a diagnostic report gender dysphoria. Conditions that the new standard, officially called Law for the real and effective equality of trans people and for the guarantee of the rights of LGTBI people, eliminates. The text establishes that the change of registered sex can be carried out from the age of 12: between 12 and 14 years, judicial approval will be required; between 14 and 16, the assistance of parents or guardians; and from 16 there will be no limitation.
The Minister Huntsman has recalled that surveys at the state level show that this law "it is one of those that generates the most social consensus of all legislative action”, therefore, in his opinion, “It is not explained that there is a debate so loaded with transphobia and hoaxes, wanting to place trans people against women”.
Once this total debate has been overcome, the Government's initiative now continues its parliamentary process in a presentation and commission, which will debate the text of the bill and the partial amendments presented. The final text, if it is finally approved in Congress, will be sent to the Senate, where it will continue its parliamentary process.
