EDITORIAL.- While we read with amazement the news about the ruling of the Court of Justice of the European Union (CJEU) endorsing the ban on homosexuals from donating blood, the publicity of a cry, a distress call, the capital letters in which we read "NEPAL EMERGENCY, EVERY SECOND ACCOUNT, DONATE NOW". Well, it will not be. It seems that thousands of citizens are going to have to renounce the right to contribute to saving a life, the right to share that which equates us in the most essential, the blood.
Because whatever the CJEU says and the legislators of 5, 50 or 500 countries, we are all brothers of blood, without distinction of race, sex, ideology or condition and excluding a group of individuals from that fraternity is, without palliative, a discriminatory and fascist behavior, but above all it is very, very dangerous because it recovers the stigma, the accusing finger of God and it turns us again into the scapegoat of this whole matter without taking into account any kind of scientific criteria.
Recommend that countries "be proportionate to the measures they adopt" and that "There must be scientific reasons and evidence to advise the exclusion measures", is an overwhelming cynicism, pure euphemism, comparable to that of the French legislators when in their day they replaced the law that prohibits donating blood the word "homosexual" by "man who has had sexual relations with other men", dodging that way the accusation of discriminating on the basis of sexual orientation. No comment.
The AIDS virus has several routes of transmission and one of them is sexual contagion, be it heterosexual or homosexual. However, according to the data that have been recorded, in France between 2003 and 2008, the 48% of new AIDS infections occurred among men who had had homosexual relationships, so what about the remaining% 52? Very simple, they are contagios produced in heterosexual relations. By the way to all these, where are the contagion statistics among lesbians? Because it is beginning to be unclear whether what does not exist is contagion among women or sexuality between women.
To donate blood in Spain, a form is filled out declaring risky sexual behaviors, basically promiscuity, whether they are homosexual or heterosexual, and that is already a possible excluding factor. In addition, all donations are analyzed for the possible presence of viruses such as HIV or hepatitis C and in the last 10 years there has not been registered a single case of contagion. Is it not scientific data about the effectiveness of certain measures to prevent possible contagion?
It is true that there is a period immediately following viral infection in which, even if tested for HIV, the virus is not detected. In the decade of 80 this period could be months, now it is reduced to hours, maximum a few days, but it is obvious that this risk exists regardless of the conduct or orientation of the donor.
The zero risk does not exist, life is not made of certainties. But there are things that we can venture to say that they will happen. The first is that there will be people who will lose their lives because blood reserves will shrink and the second one the homophobic accusations by the ignorant which will be endorsed by the highest legal entities.
