Now the Superior Court of Justice of the Region of Murcia and the Prosecutor's Office oppose his re-entry for «his authentic homophobic compulsion«.

The sentence reminds that the crime of prevarication is one of the most serious that a member of the judicial career can commit as soon as the essence of the Judiciary breaks down and the behavior minimally demanded of the one who embodies it.

The Third Chamber of the Supreme Court denied the rehabilitation to the judicial career of Fernando Ferrín Calamita, who was sentenced in 2009 by the Supreme Court to ten years of special disqualification for the office of judge or magistrate for a crime of willful trespass.

The appellant, who was a judge of the Family of Murcia, delayed the adoption proceedings of a minor by the wife of the biological mother of the girl. The high court considered then that the action of the judge constituted a crime of prevarication, and raised the sentence to ten years of disqualification and pay a fine of 620 euros, as well as to compensate the injured with 6.000 euros and face the costs of the trial.
